According to preliminary media reports, the TIEA signed between the Netherlands and the Marshall Islands on May 14, 2010, entered into force on November 8, 2011.

The TIEA applies to all taxes. The TIEA provides for the exchange of information relevant to the administration and enforcement of domestic tax laws, and the determination, assessment and collection of such taxes, the recovery and enforcement of tax claims and the investigation/prosecution of tax matters. The TIEA also provides for the exchange of information held by banks and other financial institutions, and information regarding the ownership of partnerships, trusts, and foundations. The TIEA has a mutual agreement procedure.

For companies that transfer their domicile into the Marshall Islands, is it a must to have a new set of Marshall Islands constitutional documentation, like Certificate of Incorporation and bye-law/Articles of Incorporation/Articles of Association? or can the company use it original place of domicile's Certificate of Incorporation & M&AA after they obtain the Articles of Domestication?
