Aruba
Regulatory Environment
As
of July 1st, 2008, the monthly minimum
wage was Afl1,505.25 (US$840.92). A
maximum of 8½ hours daily for a
5-day working week, not exceeding 42½
hours is allowed, or a maximum of 8 hours
daily not exceeding 45 hours for a 6-day
working week, except for enterprises such
as hotels, casinos, restaurants and oil
refining, for which shift work is required
and a maximum of 48 hours per week is
allowed.
Each
employee is entitled to a paid holiday
of at least fifteen working days per year.
Eleven days of the year are public holidays.
In
a layoff situation compensation is 1 week's
pay for every year of employment between
1-10 years, 1.25 weeks' pay for every
year of employment between 10-20 years
and 2 weeks' pay for every year of employment
above 20 years
All
visitors wishing to work in Aruba must
have a written permit from the Directorate
of Alien Integration, Policy and Admission
(DIMAS). Visitors are not allowed to be
in paid employment by an Aruban employer
while visiting Aruba as a tourist.
Applications must be filed by the potential
employer who will bear the costs.
The
principal documents to be attached to
the application include an official certificate
from the police authorities in the country
of origin certifying that the applicant
has no serious criminal convictions, a
medical certificate certifying that the
applicant carries no contagious disease
and has no mental illness, copies of job
advertisements placed in local newspapers
to which no suitable local applicants
were found, certificates verifying the
employee's qualifications and the contract
of employment which must be in accordance
with Aruba labor laws.
